Dr. Nour Bouhou, Senior Consultant, provides scheduling and change order evaluation services on large scale mixed-used projects as well as military projects requiring cost-loaded schedule reporting and time impact analysis requirement. In claims situations, she assists with schedule delay analyses, productivity impact assessments and damages quantifications. Dr. Bouhou is currently the Vice President of AACE International (AACE) Bay Area Section.
Karla Pascarella is a Partner in Peckar & Abramson’s Austin, TX office, where she represents a range of international and domestic corporate clients and construction professionals. Her practice is primarily concentrated on construction law, corporate compliance and governance, and commercial litigation/complex dispute resolution. Fluent in both Spanish and English, she regularly handles multi-cultural transactions and disputes, and assists corporate clients with strategic legal decisions and global business matters.
We are pleased to announce that we are sponsoring the American Bar Association (ABA)’s Forum on Construction Law (FCL)’s Regional Meeting, titled “Infrastructure From the Ground Up: Civil Works Projects for Lawyers,” on November 9, 2018 at the Bechtel Conference Center in the Financial District of San Francisco, CA.
This one-of-a-kind program provides a unique opportunity for both new and seasoned construction lawyers, as well as other construction industry professionals to gain a fundamental understanding of key engineering and construction issues that govern major civil works projects. Specific focus areas will include: road, bridge and rail construction; power plants; water, waste water, and solid waste facilities; and environmental and geotechnical investigations.
In addition to sponsoring the event, Spire’s Dr. Nour Bouhou and Peckar & Abramson’s Karla Pascarella will present the lunch program titled Public Private Partnership (P3) Challenges: An Infrastructure Case Study. The program will address Public Private Partnership (P3) projects, which often experience major challenges and changes during the period of performance, and require the stakeholders to engage in preventive and mitigation efforts to alleviate project cost and time impacts. The presentation will first address typical dysfunctions inherent to P3 projects, including organizational and managerial issues and funding methods. The presentation will also discuss a case study where multiple engineering-related issues arose on an infrastructure P3 project, requiring the contractor to negotiate change order requests for unforeseen soil conditions that impact design and construction, untimely review and approval of design documents, and untimely signature of the developer utility agreement. The presenters will provide the practical solutions used to develop the change order request process, including, contract entitlement review, schedule analysis and damages quantification.
All attendees will receive a copy of the book published by the ABA FCL on this subject, as well as lunch and a full day (over 6 hours) of Continuing Legal Education (CLE) instruction. More information is included in the brochure, which you can access here.
